I am not contesting here that in fact it just didn't happen, that the loans did not get paid back according to the representations. The jury found otherwise, but what I am saying was that this was not a policy. It was not an articulated policy. It was something that just happened. And now, I am kind of getting.into what I would say is my allocution, and I can stop here as far as the report is concerned, and say that up to here, that's all I have to say about the report. But I will pick right up on —
THE COURT: Well, before you leave that, most of the matters that you referred to are not matters I would take into account in sentencing. I disagree, however, that it was not the policy of the organization not to repay loans. I would make that finding as a Rule 32 finding on your paragraph 14.
The other matters in paragraph 15, 16, 17 and 18 are not matters I would take into account in sentencing, because the context of them is what you really object to, I gather, rather than the statements themselves although I do not expect you to concede the Government's version in toto.
Then with that ruling on the Rule 32, I will hear any statement you want to make on the defendant's behalf or any other information you want to bring to the attention of the Court.
